1. Definitions
The terms in this User Agreement refer to;
Yılcan Tourism: the website operated by IŞCAN MOBİLYA and DEKORASYON.TURİZM.PAZ.YAY.LTD.ŞTİ, www.yilcanturizm.com.tr,
Site: www.yilcanturizm.com.tr,
User: A person who visits the Site and/or benefits from the services offered on the Site by becoming a member,
Partners: Real or legal persons who have made agreements with Yılcan Tourism to offer their goods and services to users for a fee through the Site and under the conditions announced on the Site.
2. Subject of the Agreement
The conditions regarding the purchase and use of services offered through the Site are determined by this agreement.
3. General Conditions
3.1 Yılcan Tourism offers travel services such as overseas tours, domestic tours, cruise tours, Cyprus packages, hotels, visa services, and travel insurance via the Site. The content of the offered services is entirely at the discretion of Yılcan Tourism.
3.2 The offered travel services may vary over time depending on seasonality and availability.
3.3 Usage Conditions are an integral part of the tour programs offered on the Site and the package tour agreement to be signed after the sale and cannot be considered independently.
3.4 Persons using the Site are deemed to have accepted these Usage Conditions.
4. Travel Services
4.1 Travel services offered on the Site can be purchased instantly online with a credit card. If there are active Gift Points in the account during payment, it can be requested to be deducted from the payment amount.
4.2 In order to utilize the purchased travel service, a reservation must be made.
4.3 Tours offered on the Site are organized with a minimum participation of 40 persons. In case sufficient participation is not achieved for the tour, the latest cancellation notification date is 2 days prior to the tour departure date, and the cancellation information will be communicated by Yılcan Tourism.
4.4 Yılcan Tourism acts as an intermediary between the airline and the passenger and is subject to the 28.09.1955 Hague Protocol. There may be a risk of delays in scheduled and charter flights, or the times may change before the existing trip and flight. Yılcan Tourism is obliged to notify these changes as soon as possible. The passenger agrees to accept the risk of time changes when purchasing the tour. Children aged 0-2 do not pay airport taxes and service fees.
4.5 Triple rooms are provided subject to the availability of hotels. There is an additional bed application in triple rooms, and the 3rd bed is smaller than a standard bed. Child discounts only apply for children staying with 2 adults. The continental breakfast offered in hotels consists of butter, jam or honey, bread, tea or coffee, and fruit juice. Group breakfasts may be served in a separate hall.
4.6 Panoramic city tours are maximum 2-3 hour tours organized for the general promotion of cities. City tours may be scheduled on different days, provided that the content does not change, or may not take place due to weather conditions and/or force majeure. Extra tours specified in the tour program are organized by the local agency from which we receive service, with a minimum participation of 20 people. If sufficient participation cannot be achieved, the tours cannot be held, or the prices and content of extra tours may vary depending on the number of participants.
4.7 Passengers who do not wish to participate in extra tours to be held along the route are deemed to accept to wait at a convenient rest facility on the way.
5. Purchase of Services
5.1 The services offered on the Site can be purchased via credit card or EFT/Transfer.
5.2 In installment purchases, a maturity difference may be applied depending on the rates offered by banks on top of the cost of the service.
5.3 Yılcan Tourism collaborates with various banks and the payment system provider PayTr for the collection of the payment for the purchased service from credit cards. Transactions made through PayTr will appear as "PayTr Payment Services" on credit card statements.
6. Gift Points and Gift Point Usage
6.1 A gift point is calculated on the service fee for purchased services. After the purchase is completed, the calculated gift points are transferred to the user’s account on the Site to be used in the next purchase.
6.2 Users with active Gift Points in their accounts at the time of purchase can request that this amount be deducted as a discount from the total purchase amount. This is valid if the user logs into the Site to make a purchase.
6.3 Gift Points cannot be transferred to other users and cannot be requested as cash.
6.4 Gift Points can only be used as discounts on purchases made on the Site.
6.5 Yılcan Tourism reserves the right to cancel Gift Points in cases of malicious usage detection.
7. Cancellation and Refund Conditions
For tours and trips purchased through the Site, a package tour agreement is shared during the reservation. The cancellation and refund conditions are arranged according to the relevant clauses of the package tour agreement. Generally;
7.1 There is no right to cancel after making a reservation for promotional or discounted products.
7.2 For international tours, unless otherwise stated, if a request for cancellation is made up to 30 days before the start of the trip, the amount paid will be refunded to the consumer without any deductions, except for the mandatory taxes, fees, and similar legal obligations. The consumer agrees and undertakes to pay the full tour price as compensation to Yılcan Tourism for cancellation requests made less than 30 days before the trip starts.
7.3 For cruise tours, unless otherwise stated, if a request for cancellation is made up to 60 days before the start of the trip, the amount paid will be refunded to the consumer without any deductions, except for the mandatory taxes, fees, and similar legal obligations. The consumer agrees and undertakes to pay the full tour price as compensation to Yılcan Tourism for cancellation requests made less than 60 days before the trip starts.
7.4 Name changes can be made with a service fee of 100 Euros until 7 days before the tour departure. Name changes requested between 0-7 days will be subject to airline approval and penalties in addition to the service fee.
7.5 Visa and insurance fees for international travels and cruise tours, as well as any domestic flight ticket fees included in the tour, are non-refundable.
7.6 Natural disasters and situations such as a serious accident, serious illness requiring treatment, or death of the consumer or first-degree relatives, as described in the laws, are considered as force majeure situations for the consumer. The consumer must prove the existence of force majeure with a valid document obtained from official authorities or state hospitals. If the consumer, despite exercising all due care, cannot foresee or prevent a situation or any of the force majeure circumstances mentioned in this clause, and provides written notice of termination less than 30 days before the start of the package tour (60 days for cruise tours), then without any deductions, the payment made by the consumer will be refunded within 14 days from the date the termination notice reaches Yılcan Tourism, excluding mandatory taxes, fees, etc. and fees paid to third parties that cannot be reimbursed.
7.7 Yılcan Tourism has the right to partially or completely cancel the tours. In this case, it will be communicated to the user at least 7 days before the departure date of the international tours and at least 2 days before the departure date of the domestic tours.
7.8 For refunds made to credit cards, the reflection of the refund on the card may take up to 5 business days, depending on the banks' working conditions.
8. Visa and Passport
8.1 There is a visa application for T.C. citizens. To apply for a visa, the passport must be valid for at least 6 months beyond the travel end date, along with the documents specified in the "Required Documents for Visa" list, which can be obtained from Yılcan Tourism. Holders of green passports are exempt from visa application; having a passport valid for at least 6 months beyond the travel end date is sufficient. Having a visa does not guarantee entry into the country; the passport police have the authority to deny entry. Yılcan Tourism is not responsible for this, the liability lies with the passenger.
8.2 Guests traveling with a green passport must renew their passports if the date of issue is more than 10 years old; otherwise, they may not be accepted into the country they are traveling to, and/or their flights may be canceled by the airline from Turkey. In such a case, the liability lies with the passenger.
8.3 To avoid issues at the border with customs while visiting the destination country due to torn, worn out, wet, or similarly damaged passports; such passports should be renewed, and if the destination country requires a visa for T.C. citizens, the corresponding visa must be on the new passport. Otherwise, the liability lies with the passenger.
8.4 Visa applications can be made from 3 months prior to the departure of the tour. To ensure a smoother visa process and to avoid being affected by potential periodic busyness at the consulates and/or differences in practices, it is recommended to complete the visa application as soon as possible after 3 months remain until the tour departure date.
8.5 Minors under the age of 18 traveling alone or with only one parent may be asked for a document showing the joint consent of both parents by the police officer at the entrance and exit points of the country; thus, it is advised that minors and their parents pay attention to this issue.
8.6 Visa issuance is entirely at the discretion of the relevant consulates. In case a request is made from Yılcan Tourism for obtaining the visa service, Yılcan Tourism is responsible for sending the necessary documents to the consulate on time. Yılcan Tourism cannot be held responsible if a visa is not granted by the consulate; visa and travel insurance fees are non-refundable. In this case, the refund of the tour fee will be made according to the conditions in Article 7.
9. Force Majeure
Situations defined as force majeure in the laws are events that arise despite showing all necessary care and taking precautions due to extraordinary and unforeseen nature, which hinder the start, continuation, or completion of the package tour, and situations where Yılcan Tourism has no effect on the resulting events are considered force majeure for Yılcan Tourism. The following situations are listed;
9.1 Natural disasters such as earthquakes, fires, volcanic eruptions, floods, storms, hurricanes, fog, avalanches, lightning, and similar and not limited to these disasters or infectious diseases, nuclear events, chemical disasters or debris, as well as similar conditions and events and extraordinary situations.
9.2 Extraordinary situations in Turkey's border neighbors or in the countries to which the package tour is planned to go that hinder international land, sea, and air transportation at border crossings, war or mobilization scenarios, public uprisings, attacks or terrorist acts, sabotage, riots, occupation, civil wars, revolutions, coups, forcible takeovers, civil unrest, industrial disputes, government sanctions, embargoes, strikes, lockouts, ports being closed or filled, and all kinds of extraordinary situations that could prevent employees from working.
9.3 In cases where force majeure exists, Yılcan Tourism cannot be held responsible for any damages arising from non-fulfillment or inadequate fulfillment of the contract.
10. Responsibilities of the User
10.1 By visiting the Site or using it or by becoming a member, the User explicitly accepts and undertakes that they read, understood, and are bound by these conditions and will comply with both these conditions and all applicable laws, regulations, and other legislation regarding the Site.
10.2 Yılcan Tourism reserves the right to amend these conditions, which will take effect upon announcement on the Site. The User’s continued use of the Site after Yılcan Tourism makes changes to these conditions will be deemed as acceptance of the changes.
10.3 All written and visual content used on the Site is protected by the intellectual property rights of Yılcan Tourism, its Partners, and/or third parties. No element on the Site may be copied, reproduced, or used in any other media without the written permission of Yılcan Tourism.
10.4 The User agrees and undertakes not to engage in activities that negatively affect the functioning of the Site, reverse engineering, hacking, copying content with robots and spiders, using it for illegal purposes, and similar methods. Yılcan Tourism reserves the right to use all legal remedies and is entitled to recover all damages from users who engage in such practices.
10.5 Yılcan Tourism may use the information provided by the User when registering and during purchases for statistical evaluations, Site development, and improving user experience in any manner. The User consents to the use of this information by Yılcan Tourism for the stated purposes.
10.6 The User accepts that the security, storage, and prevention of access by third parties related to their access tools (username, password, etc.) are entirely their responsibility. Yılcan Tourism is not directly or indirectly liable for damages that may occur to the User or third parties due to negligence and faults in these matters.
10.7 The User accepts that they will receive informational emails about services and campaigns offered by Yılcan Tourism at the email address provided when registering unless they request otherwise. The User may contact Yılcan Tourism at any time to request removal from the mailing list.
10.8 The Privacy Policy of the Site is explained at http://www.yilcanturizm.com.tr/kullanim_sozlesmesi. Users visiting or becoming members of the Site are deemed to have read and accepted the Privacy Policy.
10.9 The User acknowledges and undertakes that if they violate any of the obligations they accept and undertake with this agreement, Yılcan Tourism may terminate their membership, cease their access to the Site, cancel the services they purchased, and/or initiate legal proceedings against them.
11. Notifications
Notifications to Yılcan Tourism or its Partners must be in writing.
12. Competent Court
In the resolution of disputes arising from this agreement, the courts and enforcement offices of Balıkesir and Bandırma shall be competent.
This Agreement has been read and accepted by the User and has come into force.
